Does Taking a Driver Improvement Course Remove Points or Tickets in Virginia?

Updated October 2026 · Reviewed by Billy Forte

If you searched does defensive driving remove ticket from record, the answer in Virginia is no. Virginia’s course is the Driver Improvement Clinic (DIC), and it does not take a ticket or a conviction off your DMV driving record. What it can do is lower your demerit point total by 5, once every 24 months, if you are eligible.

Key Facts

  • The ticket stays: a conviction stays on your DMV record for the time DMV lists for that violation. See what happens to the ticket.
  • The point total drops: DMV says you may earn 5 safe driving points; the Code calls this subtracting 5 demerit points. See the point benefit.
  • Limits: once every 24 months, and your balance never goes above +5. See the limits.
  • Who gets it: it depends on why you took the clinic and your age. See who gets the benefit.
  • Points or insurance: you get the point benefit or an insurance discount, not both. See points or insurance.

What Virginia Calls the Course

People search for a “defensive driving” course. In Virginia, the official name is the Driver Improvement Clinic, or DIC. DMV says the Driver Improvement Clinic teaches defensive driving techniques.

The Virginia DMV Driver Improvement page sets the basics. The clinic is an 8-hour course.

It costs no more than $100. You can take it online or in person.

Online, you must use a DMV-licensed online provider. The 8 hours include the final test. For more on the online format, see our guide to the 8-hour online clinic.

What Happens to the Ticket

A finished clinic does not change your conviction. The ticket stays on your DMV record for the full time DMV lists for that violation. The clinic has no effect on that clock.

DMV’s Moving Violations and Point Assessments page explains that convictions and points follow separate dates. The years each conviction stays are shown on DMV’s point lists. Here are a few examples:

  • Speeding: 5 years.
  • Reckless driving: 11 years, as shown on DMV’s six-point list.
  • Many other 3- and 4-point violations: 3 years.

A suspension or revocation can keep convictions on the record even longer. Our guide on how long violations stay on a Virginia record covers each period.

Does Defensive Driving Remove Ticket From Record in Virginia?

No, the Driver Improvement Clinic works on points, not on tickets. In Virginia, a “defensive driving” course means the DIC. Finishing the clinic does not take a conviction off your DMV record.

If a court orders the clinic, the court decides its effect in your case. That is covered below.

What the Clinic Does to Your Points

The clinic changes your point total, not your list of convictions. DMV says, “You may be awarded 5 safe driving points, once every 24 months, after you successfully complete a driver improvement clinic.”

The Code says the same thing in other words. Code of Virginia § 46.2-498 says a driver who finishes a clinic “shall have five demerit points subtracted from his total accumulation of demerit points.”

So there are two ways to say it:

  • DMV’s words: you earn 5 safe driving points.
  • The Code’s words: 5 demerit points are subtracted from your total.

Both describe one benefit. Your point total goes down by 5. The conviction stays.

If You Have Fewer Than 5 Demerit Points

The Code also covers drivers with fewer than five demerit points. They get a smaller reduction, safe driving points, or both.

Here is a simple example. A driver with 10 demerit points who earns the benefit has a total that is 5 points lower.

A driver with no demerit points earns safe driving points instead. Our guide on how a driving course reduces points walks through the math.

The Limits on the Point Benefit

The benefit has firm limits. Each one comes from DMV or the Code:

  • Once every 24 months. The Code says the benefit can be awarded “no more than once in a two-year period.”
  • A cap of +5. DMV says, “The highest safe driving point balance you may accumulate on your driving record is 5 points.”
  • Eligible completions only. Not every clinic earns points, as the next section shows.

Taking a second clinic inside 24 months does not earn a second 5 points. See how often you can take the clinic for the repeat rules.

Who Gets the Point Benefit

Your reason for taking the clinic decides whether you get points. When you sign up, you tell the provider your reason and show a government photo ID. DMV’s reasons page lists four reasons: court, DMV, voluntary and insurance.

  • Voluntary: yes, you can earn the 5 points.
  • DMV-ordered, age 18 or over: yes.
  • DMV- or court-required, under 18: no. A parent may also attend that clinic and get the point benefit, under Code § 46.2-334.01.
  • Court-ordered: the court decides.
  • Insurance discount: no points.

Our guide on earning safe driving points explains each case in more detail.

Court-Ordered Clinics and Your Ticket

A court may order a clinic for a person found guilty of a traffic offense. Code § 46.2-505 sets the rules. The court decides whether you get safe driving points. Without the court’s notice, DMV awards no points.

DMV says you must give the clinic the court’s paper before DMV can award points. You must also tell the court whether you finished. Not finishing may be punished as contempt of court.

There is one more limit. A court cannot use a clinic to reduce, dismiss or defer a conviction for a CDL holder.

For your own case, ask the court or a Virginia attorney. Our court-ordered clinic guide has the full rules.

DMV-Ordered Clinics

DMV orders a clinic for an adult at 12 points in 12 months or 18 points in 24 months. You must finish within 90 days. If you do not, DMV suspends your license until you finish.

A DMV-ordered clinic for a driver 18 or over earns the 5 points. It still does not remove the tickets that led to the order. After the order, you also serve 6 months of probation and then an 18-month control period.

Points or an Insurance Discount

You get the point benefit or an insurance discount, not both, once in 2 years. If you take the clinic for insurance, DMV says “you will not be eligible to receive safe driving points.”

The insurance rule is in Code § 38.2-2217. It has three limits:

  • An insurer may give a discount. It does not have to.
  • The driver must be 54 or younger and take the clinic voluntarily.
  • The discount lasts 2 years. Court- or DMV-required clinics do not qualify.

See our insurance discount guide for the details.

Tickets, Points and Records Compared

People mix up three things: the ticket, the points and the record. This table shows how the clinic affects each one.

ItemHow long it countsDoes the clinic change it?
The convictionThe period DMV lists for that violationNo
Demerit points2 years from the offense dateYes, the total drops by 5
Safe driving point balanceUp to +5Yes, if you are eligible
Insurance company pointsSet by each insurerNot part of DMV points

Demerit points count for 2 years from the offense date, under Code § 46.2-493. DMV also says insurance company points “are not related to DMV demerit points.”

What We Found on the Official Pages

On the official pages we checked on October 27, 2026, DMV’s Driver Improvement page still said a clinic may earn 5 safe driving points, once every 24 months. It also still said the highest balance is 5 points.

The text of Code § 46.2-498 had no change since 1998. It still said 5 demerit points are “subtracted” from the total. We found no page that says a clinic removes a conviction.

Common Mistakes

Each item below comes from a Virginia DMV page or the Code:

  • Expecting the ticket to disappear. The conviction stays for its listed period.
  • Taking the clinic for insurance and expecting points. Insurance-only completions get no points.
  • Taking a second clinic inside 24 months. The benefit comes only once in that time.
  • Expecting a balance above +5. DMV caps the safe driving point balance at 5.
  • Assuming a court-ordered clinic earns points. The court decides.
  • Missing a DMV deadline. A DMV-ordered clinic must be finished within 90 days.
  • Using a provider DMV has not licensed. Online clinics must come from a DMV-licensed online provider.

How Requirements Can Vary

Virginia’s point rules, safe driving points and DMV clinic orders come from the Code of Virginia and DMV rules, and they apply statewide. What you must do still depends on whether you take the clinic by choice, because of a DMV notice, or under a court order. A court order sets its own deadline and proof steps.

Laws, fees and court practice can change. Check your DMV notice, your court order and the Virginia DMV website for current rules before you enroll or file anything.

Frequently Asked Questions

Does defensive driving remove a ticket from your record in Virginia?

No, the Driver Improvement Clinic (DIC) does not take a ticket or a conviction off your DMV record. It can lower your demerit point total by 5 if you are eligible.

Does a driving school take points off in Virginia?

A Driver Improvement Clinic from a DMV-licensed provider can lower your point total by 5, once every 24 months. DMV calls this 5 safe driving points. The Code says 5 demerit points are subtracted from your total.

How long does the conviction stay after I finish the clinic?

It stays for the period DMV lists for that violation. Speeding stays 5 years, and reckless driving stays 11 years. The clinic does not shorten that time.

Can I take the clinic again to earn another 5 points?

Not within 24 months. The Code allows the benefit no more than once in a two-year period. Your safe driving point balance also cannot go above +5.

Do I get points if a court ordered the clinic?

Only if the court says so. Under Code § 46.2-505, the court decides whether you receive safe driving points. Give the clinic the court’s paper so DMV can act on it.

Will the clinic lower my insurance?

It may, but your insurer does not have to give a discount. The law allows one for drivers 54 or younger who attend voluntarily. If you choose the insurance benefit, you get no safe driving points.

Do demerit points go away on their own?

Yes. Demerit points count for 2 years from the offense date. That rule is separate from how long the conviction stays on your record.

Conclusion

A Virginia Driver Improvement Clinic does not remove a ticket or a conviction from your driving record. It can lower your point total by 5, once every 24 months, if your reason for attending qualifies. Take the Virginia Driver Improvement Course. If a court ordered your clinic, ask the court first whether it accepts an online course.
