What Is a Safe Driving Points Balance in Virginia?

Updated October 2026 · Reviewed by Billy Forte

Your safe driving points balance is the safe driving points you have earned, set against the demerit points that are still active on your Virginia record. Safe points are credits, and demerit points are debits, so the number shows which side is ahead. Virginia law lets DMV use the credits to offset an equal number of demerit points.

Key Facts

What a Safe Driving Points Balance Means

Think of the balance as a simple ledger. One column holds safe driving points. The other holds demerit points from convictions that still count.

Code § 46.2-494 lets DMV “apply these points to offset an equivalent number of demerit points.” So one safe point cancels one demerit point. What is left over is your balance.

A positive balance means your credits are ahead. A balance with more demerit points than safe points means convictions are ahead.

The Two Parts of the Number

Each part comes from a different rule.

Safe driving points are rewards. DMV’s Points System page names two sources:

  • One point for each full calendar year you hold a valid Virginia license and drive with no violations or suspensions.
  • Five points for an eligible Driver Improvement Clinic, once every 24 months.

Demerit points are penalties. A conviction adds 3, 4 or 6, based on the offense. Under Code § 46.2-493, they count for 2 years from the date of the offense.

The Virginia DMV points system guide explains how the two kinds of points fit together.

How Offsetting Works

The math is plain subtraction. These rows show how a few totals net out.

Safe points earnedActive demerit pointsWhat is left
50A balance of +5

22The two sides cancel out

Offsetting does not change your conviction history. The conviction stays on your record for the period DMV lists for that violation.

Why the Balance Changes

Your balance is not fixed. Five things move it:

  • April credits. DMV adds yearly safe points in early April for the calendar year before.
  • New convictions. Each one adds 3, 4 or 6 demerit points on the conviction side.
  • The 2-year count. Demerit points stop counting 2 years after the offense date.
  • A clinic. An eligible completion adds 5 safe points, once every 24 months.
  • The cap. Credits stop growing once the balance reaches +5.

The 2-year count has one exception. Points that DMV relied on for a suspension, probation or similar action remain valid until that action is over. Our guide on how long points stay has the details.

Who Earns the Yearly Point

The yearly credit has a strict test. Code § 46.2-494 awards one safe driving point “for each calendar year of safe driving.” The record for that year must not contain any suspension, revocation, conviction or finding of not innocent.

DMV adds one more condition. You must hold a valid Virginia license for the full calendar year. A year with a single point conviction earns no credit, even if the rest of the year was clean.

So the yearly credit rewards whole years. It does not count months, and it is not paid early.

The +5 Ceiling

DMV’s Driver Improvement page says the highest safe driving point balance you can build is 5 points. Code § 46.2-494 says the same: no one may hold more than five safe driving points.

The cap affects planning. A driver with a balance of +5 gains nothing from another clean year. That driver also gains no extra safe points from a clinic that would push the total past 5.

The cap applies to safe points. It does not stop new demerit points from posting after a conviction.

What the Balance Does Not Tell You

The balance is a point count, not your full history. Three things sit outside it:

  • Conviction history. Convictions stay on the record for their own periods. Speeding stays 5 years, and reckless driving stays 11.
  • Insurance points. DMV’s Moving Violations page says insurance company points “are not related to DMV demerit points.”
  • Violations with no points. DMV also posts traffic violations that carry no demerit points.

DMV adds that point dates “are not related to the dates that convictions are removed.” So a balance of +5 can sit next to a conviction that is still listed.

Tickets From Other States

Out-of-state tickets can move your balance too. DMV’s Moving Violations page says demerit points “will also be assigned to your record for traffic convictions incurred in other states.”

Those points land on the demerit side, the same as a Virginia conviction. They count for the same 2 years from the offense date.

How the Balance Ties to DMV Action

DMV watches your demerit point total over 12-month and 24-month windows. Reaching set levels can bring a letter, a required clinic or a suspension. The points system guide lists each level.

Safe points can help because the Code lets DMV use them as an offset. Still, read any DMV notice closely. The notice tells you what DMV has decided in your case.

How to See Your Balance

DMV’s Online Record Request page offers a “Points Balance” link. That is the simplest place to look.

DMV’s points pages make the same suggestion. They say to “check your points balance to see where your record stands” and link to a log-on page for it.

You can also order a full driving record from DMV. Our guide on how to check points covers the ways to order one and the fees.

Check before you plan a clinic. If your balance is already +5, a voluntary clinic may not add any safe points.

Adding Points with a Clinic

A Driver Improvement Clinic (DIC) runs 8 hours and is given by a provider DMV has licensed. Its price is capped at $100, and both online and classroom formats exist.

Code § 46.2-498 says a completer has five demerit points subtracted from the point total. With fewer than five points, the Code says a reduction and/or an award of safe driving points is made. The conviction stays on your record either way.

Whether you get the 5 points depends on why you attend:

  • You chose to attend: the 5 points apply, once every 24 months.
  • DMV sent you and you are 18 or older: the points apply.
  • A court sent you: the court decides.
  • You are under 18 and had to attend: no points.
  • You attended for an insurance discount: no points.

At sign-up you must tell the provider your reason and show a government photo ID, according to DMV’s reasons page. Our guide to earning safe driving points covers each case.

Points or an Insurance Discount

A clinic can give one of two benefits, not both at once. Code § 46.2-498 lets you pick the point benefit or a reduction in insurance premium. You must tell the provider which one you want.

If you pick the insurance discount, your balance does not change. One year after you complete the clinic, you may take it again by choice for the other benefit.

The discount itself is up to your insurer. Under Code § 38.2-2217, an insurer may give a 2-year discount to a driver 54 or younger who attends by choice. Clinics required by a court or DMV do not qualify.

Questions to Ask Before You Rely on the Number

A few checks help you read the balance the right way:

  1. When did I check? The yearly credit posts in early April, so the number can change then.
  2. When was each offense? Points count from the offense date, not the court date.
  3. Is DMV action running? Points used for a suspension or probation stay valid until it ends.
  4. Did I take a clinic in the last 24 months? If so, another clinic adds no new points yet.
  5. Am I already at +5? Then more credits will not raise the balance.

What We Found on the Official Pages

On the DMV pages we checked on October 27, 2026, the Points System page still said yearly safe points are awarded in early April. The Driver Improvement page still listed +5 as the highest balance.

The Online Record Request page still offered the “Points Balance” link. None of these pages explained how the balance is printed on a record, so we do not describe that here.

Common Mistakes

Each item below comes from the Code of Virginia or a DMV page:

  • Thinking safe points erase a conviction. They offset points; the conviction stays listed.
  • Expecting more than +5. No one may hold more than five safe driving points.
  • Looking for the yearly point in January. DMV adds it in early April.
  • Counting a year with a violation. Only a year with no violations or suspensions earns the point.
  • Taking the clinic for insurance and expecting points. Insurance-only completions earn no safe points.
  • Mixing up DMV and insurance points. They are separate systems.

How Requirements Can Vary

Virginia’s point rules, safe driving points and DMV clinic orders come from the Code of Virginia and DMV rules, and they apply statewide. What you must do still depends on whether you take the clinic by choice, because of a DMV notice, or under a court order. A court order sets its own deadline and proof steps.

Laws, fees and court practice can change. Check your DMV notice, your court order and the Virginia DMV website for current rules before you enroll or file anything.

Frequently Asked Questions

What is a safe driving points balance?

It is your safe driving points set against your active demerit points. DMV can use each safe point to offset one demerit point. What remains is your balance.

What is the highest balance I can have?

The highest balance is +5. Once you reach it, a clean year or a clinic adds no more safe points.

When does DMV add the yearly safe point?

DMV awards yearly safe points in early April for the calendar year before. You must hold a valid Virginia license and have no violations or suspensions that year.

Does my balance include old convictions?

No. Demerit points count for 2 years from the offense date, unless DMV used them for an action that is still running. The conviction can stay listed longer, but its points no longer count after that time.

Can a clinic raise my balance?

Yes, if you are eligible. A completed clinic can add 5 safe points once every 24 months, up to the +5 cap. Taking it for an insurance discount earns no points.

Does a court-ordered clinic add safe points?

Only if the court says so. Code § 46.2-505 lets the court decide, and without the court’s notice DMV awards no safe points. Bring the court’s paper to the clinic.

Do tickets from other states change my balance?

Yes. DMV assigns demerit points for traffic convictions in other states. Those points sit on the demerit side and count for 2 years from the offense date.

Where do I see my balance?

Use the “Points Balance” link on DMV’s online record request page. You can also order a driving record from DMV.

Conclusion

Your safe driving points balance shows whether credits or demerit points are ahead on your Virginia record. Clean years and an eligible clinic add credits, and the balance stops at +5.

If your balance needs help and you are eligible, you can take the Virginia Driver Improvement Course. If a court ordered your clinic, ask the court whether it accepts an online course.
