Virginia Work Zone and School Zone Speeding Tickets: Higher Fines

Updated October 2026 · Reviewed by Billy Forte

If you searched work zone speeding ticket virginia, the short answer is that work zone and school zone tickets can cost more, but the Code does not double them. A work zone speeding fine can be up to $500 when workers are present, and a school crossing zone fine can be up to $250. If you prepay, both zones charge $7 for each mph over the limit instead of $6.

Key Facts

  • Work zone cap: a fine up to $500 when workers are present and signs show the limit and the penalty. See work zone rules.
  • School zone cap: a 25 mph limit between the school signs, and a fine up to $250. See school zone rules.
  • Prepaid rate: $7 per mph over in both zones, compared with $6 on other roads. See prepaid rates.
  • Other work zone violations: other moving violations carry minimum fines of $300, $500 or $750. See other violations.
  • Points: demerit points follow the speed on the conviction. See points.
  • Reckless line: 20 mph or more over, or over 85 mph, is reckless driving in any zone. See reckless driving.

Not Doubled, but Capped Higher

No official Virginia source we checked says these penalties double. Instead, the Code sets its own caps for each zone. It also sets a higher prepaid rate per mph.

The two zones work under different laws. A work zone ticket falls under Code § 46.2-878.1. A school zone ticket falls under Code § 46.2-873, which uses the term “school crossing zone.”

Work Zone Speeding Ticket Virginia Rules

Code of Virginia § 46.2-878.1 covers speeding in a highway work zone. The higher penalty applies only when two things are true:

  • Workers are present in the work zone.
  • Signs are posted that display the maximum speed limit and the penalty for violations.

When both are true, the violation is “punishable by a fine of not more than $500.” That is a cap, not an amount added to another fine.

When Workers Are Not There

The statute ties the $500 cap to workers being present. Without workers present, that part of § 46.2-878.1 is not met. The $7 prepaid rate is also tied to a violation of this section.

Other Moving Violations in a Work Zone

Another law covers moving violations in work zones. Code § 46.2-808.3, with a 2024 history entry, applies when workers are present and signs are posted. It sets minimum fines:

  • First offense: not less than $300.
  • Later offense: not less than $500.
  • Within 12 months of another work zone moving violation: not less than $750.

The two laws do not stack for one act. A prosecution under § 46.2-878.1 bars one under § 46.2-808.3 for the same act, and the reverse is also true.

School Zone Speeding Ticket Rules

Code § 46.2-873 sets the rules for school crossing zones. It says, “The maximum speed limit shall be 25 miles per hour between portable signs, tilt-over signs, or fixed blinking signs.”

A violation is a traffic infraction “punishable by a fine of not more than $250.” The Code also has a 15 mph option for some residential school zones.

When the School Zone Limit Applies

The limit depends on the school signs and the time of day. The signs are in use:

  • For 30 minutes before regular school hours.
  • For 30 minutes after regular school hours.
  • At other times when the presence of children requires it.

A locality may extend the 30-minute periods to 60 minutes. Look for the signs, since they mark where and when the zone is active.

Prepaid Rates in Each Zone

If your charge can be prepaid, Code § 46.2-878.3 sets the rate per mph over the limit. This table shows how the two zones compare with other roads:

Where you were speedingWhen the zone rule appliesPrepaid rate per mph overFine cap in the Code
A road with no special zoneNot a zone case$6No zone cap
School crossing zoneSigns posted or lit at the set times$7$250
Highway work zoneWorkers present and signs posted$7$500

So each zone adds $1 for each mph over to the prepaid fine. A fixed court cost of $51 is added under § 16.1-69.48:1, and other fees can be added. Our fines guide covers the math for other speeds.

Prepaying Is a Guilty Plea

Prepaying under Code § 16.1-69.40:1 is a guilty plea. The conviction goes to DMV. If you go to court instead, missing the court date adds a $35 fee.

Talk to the court or a Virginia attorney about your own case before you decide.

Residence Districts Use a Third Rate

School and work zones are not the only places with a higher prepaid rate. Section 46.2-878.3 sets $8 per mph over for speeding in a posted residence district. Our fines guide covers that rate with the others.

How to Tell Which Rule Applies to You

The charge decides which rule applies. A charge under § 46.2-878.1 is a work zone case, and a charge under § 46.2-873 is a school crossing zone case. If you are not sure which one you face, call the clerk of the court named on your summons.

Points Follow the Conviction

Points follow the speed on the conviction. Under Code § 46.2-492, points depend on the speed over the limit:

  • 1 to 9 mph over: 3 points.
  • 10 to 19 mph over: 4 points.
  • 20 mph or more over: 6 points.

Points count for 2 years from the offense date. The speeding conviction stays on your DMV record for 5 years.

For drivers 18 and over, points can lead to DMV action. DMV may send an advisory letter at 8 points in 12 months, and it requires a clinic at 12 points in 12 months. Our guide on speeding ticket points covers points in full.

When a Zone Ticket Becomes Reckless Driving

The reckless driving line applies in zones too. Under Code § 46.2-862, driving 20 mph or more over the limit, or over 85 mph, is reckless driving.

In a 25 mph school crossing zone, 45 mph is 20 mph over the limit. Reckless driving is a Class 1 misdemeanor, with up to 12 months in jail, a fine up to $2,500, or both. It cannot be prepaid.

Speed Cameras in These Zones

School crossing zones and work zones are also places where speed cameras may be used. A camera in a work zone may run only when workers are present.

Under Code § 46.2-882.1, a mailed camera summons is a civil penalty of up to $100. The camera can only be used when a vehicle is at least 10 mph over the limit.

That mailed summons is not a conviction and is not on your driving record. A ticket an officer hands you is different. See our speed camera guide for details.

Where a Driver Improvement Clinic Fits

Taking a Driver Improvement Clinic leaves the zone fine and the conviction as they are. Its effect is on your DMV point balance. DMV-licensed providers run the 8-hour clinic, and the price is capped at $100.

A driver who attends by choice and is eligible can earn 5 safe driving points, no more than once in 24 months. You get either the point benefit or an insurance discount, not both. If a court orders the clinic, Code § 46.2-505 says the court decides on points.

Young Drivers and CDL Holders

A zone ticket can trigger other rules. DMV directs drivers aged 18 and 19 to a clinic after a conviction that carries demerit points, under Code § 46.2-334.02. For a driver under 18, a first point conviction brings the same clinic order.

For a CDL holder, speeding 15 mph or more over the limit is a serious traffic violation under 49 CFR 383.51. That rule applies in a zone like anywhere else.

What We Found on the Official Pages

We read each zone law again on October 27, 2026. Section 46.2-873 showed a history line ending in 2026, chapter 337. Its current text still set the 25 mph limit and the $250 cap.

Section 46.2-878.1 showed no change since 2012 and still capped the fine at $500. Section 46.2-808.3 still listed the $300, $500 and $750 minimums, and § 46.2-878.3 still set $7 per mph in both zones.

Common Mistakes

Each item below comes from the Code of Virginia:

  • Expecting the cost to be doubled. The Code sets caps of $500 and $250, not a double charge.
  • Treating $500 as an add-on. It is the most the fine can be, not an extra amount.
  • Watching for students instead of signs. The school zone limit runs on posted or lit signs at set times.
  • Ignoring the work zone signs. The $500 cap needs workers present and signs that show the limit and the penalty.
  • Using the regular prepaid rate. It is $7 per mph in both zones, not $6.
  • Forgetting the reckless line. 20 mph or more over is reckless driving in any zone.
  • Treating a camera notice as a conviction. A mailed camera summons is a civil penalty, not a conviction.
  • Mixing up the two work zone laws. A prosecution under one bars a prosecution under the other for the same act.

How Requirements Can Vary

Virginia’s point rules, safe driving points and DMV clinic orders come from the Code of Virginia and DMV rules, and they apply statewide. What you must do still depends on whether you take the clinic by choice, because of a DMV notice, or under a court order. A court order sets its own deadline and proof steps.

Laws, fees and court practice can change. Check your DMV notice, your court order and the Virginia DMV website for current rules before you enroll or file anything.

Frequently Asked Questions

Does Virginia double the penalty for work zone speeding?

No official source we checked says so. The work zone fine can be up to $500 when workers are present and signs are posted, and the prepaid rate is $7 per mph over.

How much is a school zone speeding ticket in Virginia?

The fine can be up to $250 under Code § 46.2-873. If prepaid, it is $7 for each mph over the limit, plus a $51 court cost.

Do workers need to be present for the higher work zone fine?

Yes. Code § 46.2-878.1 ties the $500 cap to workers being present and signs showing the speed limit and the penalty.

What hours does the school zone limit apply?

The 25 mph limit applies while the school signs are in use. That is 30 minutes before and after regular school hours, and other times children are present. A locality may extend this to 60 minutes.

Does a zone ticket add extra points?

Points follow the speed on the conviction under Code § 46.2-492: 3, 4 or 6 points. The zone laws we checked set fines and prepaid rates.

Can I prepay a work zone or school zone ticket?

If the charge is on the prepayable list, yes, at $7 per mph over. Prepaying is a guilty plea. Reckless driving cannot be prepaid.

Does a work zone ticket count against a CDL?

For a CDL holder, speeding 15 mph or more over the limit is a serious traffic violation under 49 CFR 383.51. The zone does not change that rule.

Is a camera ticket in a school zone the same as an officer’s ticket?

No. A mailed camera summons is a civil penalty of up to $100 and is not a conviction. An officer’s ticket is a regular traffic case.

Conclusion

Virginia work zone and school zone speeding tickets cost more because of higher caps and a $7 prepaid rate, not because the Code doubles them. Points still follow the speed on the conviction.
